FULL TERMS AND CONDITIONS
These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of these Terms and Conditions and by participating all participants will be deemed to have accepted and be bound by them. Participants should retain a copy for their information.
The Promoter takes data protection seriously. By entering this promotion, participants confirm that they have read the Privacy Policy and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation in the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.
- The promotion is open to specially selected Nestlé Professional customers based in the UK (England, Wales, Scotland, and Northern Ireland) aged 18 years or over only, and excludes the Promoter’s employees, their immediate families, agents, or anyone professionally connected to the promotion.
- Participants will be invited to complete the NESCAFÉ FEEDBACK SURVEY, which they will receive a link to in an email, on the official survey platform, by no later than 23:59 on 30.04.26. Internet access to the promotional website and registration with a genuine personal email account required for entry.
- A completed, valid entry will be where the full survey, with every question is completed and survey submitted correctly including the participant’s first name, last name and email address. Maximum one survey/entry per person throughout the duration of the promotion.
- All respondents who complete a valid/genuine survey by the stated end date will be entered into a prize draw for a chance to win one (1) of five (5) NESCAFÉ Hampers containing the following items: 1 x NESCAFÉ Barista Signature Coffee Beans 1kg, 1 x KitKat Hot Chocolate 40 Sachets, 1x Starbucks Medium Roast 50 Sachets, 1 x NESCAFÉ Espresso Concentrated Iced Classic 500ml, 1 x Limited Edition Red Mug and Notebook, 1 x A4 information card detailing what is included and a spotlight on our NPD.
- The prize draw will take place within 14 standard working days of the closing date and the winners notified within a further 14 days via email to the email address stated within the respondent’s survey. No cash or other alternative will be available. The prize will be sent via courier to an agreed UK address where it can be signed for following a verification process.
- The survey cannot be accessed or completed via any other route than as outlined above.
- No responsibility will be accepted for surveys which are incomplete, incorrectly completed, not received for whatever reason or for any technical or other error that may arise with any entry.
- The survey and the chance to win one of the prizes as outlined above will only be available via the promotional website and cannot be accessed in any other way. The entry instructions form part of the promotional Terms and Conditions. By entering, participants agree to accept and be bound by these Terms and Conditions.
- By participating in the Promotion, the survey respondents license and grants the Promoter an exclusive, royalty free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish, and display such content for any purpose in any media, without compensation, restriction on use, attribution, or liability. Participants agree not to assert any moral rights in relation to such use where the moral rights in respect of the content are theirs to assert. Participants warrant that any comments are their own, have not been copied, in whole or in part, from any third party and they have full authority to grant these rights.
- Due to the nature of the entry mechanic and prize, participants must be 18 years or over.
- Maximum one entry per person. The Promoter reserves the right to determine, in its sole and absolute discretion, whether a participant has already completed a survey and been entered into the prize draw.
- Limitations of Liability: Neither the Promoter nor the promotional parties assume any responsibility or liability for:
- Any incorrect or inaccurate submission during the registration/survey process, or for any faulty or failed electronic data transmissions.
- Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of this Promotion.
- Inaccessibility or unavailability of the internet or the website or any combination thereof.
- Regretfully, the Promoter cannot be held liable for system failures on the website.
- Entries (bulk or otherwise) from third parties, or automated entries are not permitted. If it becomes apparent that a participant, or group of participants, are using any means to circumvent this condition such as, and without limitation, using multiple identities, acting fraudulently or dishonestly in the opinion of the Promoter, or otherwise acting in violation of these Terms and Conditions, these participants will be disqualified, and any gift entitlement will be void.
- The first five (5) genuine, valid respondents drawn by an independent third party using a random computer process on behalf of the Promoter will be deemed the winners. The winners will be notified within 14 days of the draw date via email and advised of the claims process. Winners are required to confirm acceptance of the prize within 14 days of the notification date in order for them to receive their prize. Once verified, the prize will be sent to the email address provided. The Promoter is not responsible for any prizes lost due to incorrect details being provided.
- The Promoter will make all reasonable efforts to contact the winner(s), however, if a winner cannot be contacted after 28 days of the original notification and after three (3) attempts, or if a selected winner is ineligible, otherwise in breach of these Terms and Conditions, or unable to take up their prize for any other reason, they shall be disqualified and will lose their entitlement to the prize. In such circumstances, the Promoter reserves the right to select a reserve entrant(s) from the reserves selected as next in line at the time of the initial prize allocation. In the event of a need to contact a reserve, this will continue/be repeated until an eligible winner is able to claim the prize, or after two (2) reserves have been tried. Thereafter, any remaining prize will be forfeited and withdrawn from the promotion and declared null and void. It is the entrants’ responsibility to ensure that they check their junk for any winning messages and prizes.
- Winner(s) will be subject to a full verification process.
- In the event of circumstances beyond its control, the Promoter reserves the right to substitute the stated prize with an alternative item of equal or greater value.
- Promoter reserves the right to verify participants including asking for proof of age, identity and address, and to refuse to award the gift where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, or any instructions forming part of this promotion’s entry requirements, or otherwise where a participant has gained an unfair advantage in participating in the promotion or using fraudulent means.
- The prizes must be accepted as offered by the named recipients. There is no cash or other alternative item, in whole or part available in lieu of the stated item. The item is not transferable. Any personal/business tax liability arising from taking part in this promotion will be the responsibility of the individual participant/business.
- Promoter’s decision in all matters shall be final and binding.
- The Promoter reserves the right at its sole discretion to disqualify any participant found to be tampering with the entry process or the operation of the survey; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
- The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
- If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event, or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
- The Promotion and these Terms and Conditions will be governed by the laws of England and Wales and any disputes as to the meaning of these Terms and Conditions will be subject to the exclusive jurisdiction of the participants’ local courts.
- By taking part in the promotion, the winners agree that the Promoter may contact them to ask whether they want to participate in marketing activities/PR relating to this promotion only. Such publicity may include, without limitation, the participant’s name and/or if consent given, image or statements made by entrants concerning the promotion and/or prize obtained as part of the promotion. The winners are not obliged to agree to any such request.
- Subject to the Promoter’s Privacy Policy which can be found at Policy https://www.nestle.co.uk/en-gb/privacypolicy, the surname and county of the winners will be available upon request by sending an email to: consumer.services@uk.nestle.com with the subject line “WINNERS’ LIST: NESTLÉ PROFESSIONAL NESCAFÉ FEEDBACK SURVEY” for a period of 90 days following the end of the promotion. The Promoter reserves the right to refuse any or all such requests. When contacting this email address, your request will be actioned in line with Nestlé’s Privacy Policy. If the winner objects to their information being published, then they can contact the Promoter by emailing: UKI.Dataprotection@uk.nestle.com with the subject line “WINNERS’ LIST: NESTLÉ PROFESSIONAL NESCAFÉ FEEDBACK SURVEY”. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so.
- Data Protection: The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent, and you have opted-in to receive future marketing communications or prize PR. The surnames and counties of the verified winner will be made available as set out above and the winner can object to this by emailing: UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential, and in accordance with the General Data Protection Regulation (GDPR). You can request access to your personal data, or have any inaccuracies rectified, or request deletion of data by sending an email to: UKI.Dataprotection@uk.nestle.com. By participating in the promotion, you agree to the use of your personal data as described here. You can withdraw your consent at any time. For the purpose of this promotion, requests to delete personal data can only be actioned after the promotion has concluded and the winner(s) accepted their prize. Any data obtained via this promotion will be deleted 90 days after the promotional end date with the exception of the winner(s) and/or reserve(s) whose data will be deleted after fulfilment of the prize.
- No responsibility can be accepted for any entries that cannot be made, due to technical errors, or any other reason whatsoever.
- If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable, then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
