Nestlé Professional Nescafé Healthcare Prize Draws: Full Terms & Conditions
These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of these Terms and Conditions and by participating all participants will be deemed to have accepted and be bound by them. Participants should retain a copy for their information.
The Promoter takes data protection seriously. By entering this promotion, participants confirm that they have read the Privacy Policy and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation in the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

The promotion is open to residents of the UK (England, Wales, Scotland, and Northern Ireland) aged 18 years or over only, except for anyone directly connected with the planning or administration of the prize promotion including the Promoter’s employees, their immediate families, agents, or anyone professionally connected to the promotion.

Open to UK based visitors, 18+ who attend one of the trade shows/forums taking place between April and November 2024. Nestlé Professional will be inviting attendees to take part in a short survey. All those who complete a genuine survey will automatically be entered into the prize draw for a chance to win a NESCAFÉ Dolce Gusto Genio S Plus machine. The surveys will close at the end of each show/forum.

The winners will be drawn at random and contacted via email within seven (7) standard working days of each survey closing date. There is one prize available to be won in total at each venue, but no one person may win more than one prize throughout the duration of the promotion. One entry will automatically be entered into the relevant prize draw upon completion of a survey.

Procurex, 16th May 2024 at Liverpool
P4H England, 3rd July 2024 at Birmingham

Participants will be invited to complete the NESCAFÉ Healthcare Survey via NESCAFÉ Healthcare Survey (office.com) the official survey platform during each event.

A completed, valid entry must be where the full survey, with every question is completed and survey submitted correctly including the participant’s first name, last name, email address, business name, business type, job function (optional) and daytime phone number (optional). Maximum one survey/entry per person throughout the duration of the promotion.

All those who complete a valid/genuine survey within the stated dates will automatically be included in the prize draw for a chance to win the prize. All those who respond to the survey will have the same chance of winning. The survey cannot be accessed or completed via any other route than as outlined above.

Any participant who wishes to complete the survey but does not wish to be included in the prize draw may click the box to remove their survey response from the prize draw.

No responsibility will be accepted for surveys/prize draw entries which are incomplete, incorrectly completed, not received for whatever reason or for any technical or other error that may arise with any entry.

The Promoter cannot be held responsible for any changes, including changes to the dates or venue of the event listed, which is outside its control.
4. The survey and prize draw will only be available at the event listed and cannot be accessed in any other way. The entry instructions form part of the promotional Terms and Conditions. By entering, participants agree to accept and be bound by these Terms and Conditions.
5. By participating in the Promotion, the survey respondents license and grants the Promoter an exclusive, royalty free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish, and display such content for any purpose in any media, without compensation, restriction on use, attribution, or liability. Participants agree not to assert any moral rights in relation to such use where the moral rights in respect of the content are theirs to assert. Participants warrant that any comments are their own, have not been copied, in whole or in part, from any third party and they have full authority to grant these rights.
6. Maximum one entry per person at each event and no one person may win more than one prize throughout the entire duration of the survey prize draws. The Promoter reserves the right to determine, in its sole and absolute discretion, whether a participant has already completed a survey, entered the prize draw and won a prize.
7. Limitations of Liability: Neither the Promoter nor the promotional parties assume any responsibility or liability for:

Any incorrect or inaccurate submission during the registration/survey process, or for any faulty or failed electronic data transmissions.

Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of this Promotion.

Inaccessibility or unavailability of the internet or the website or any combination thereof.

Regretfully, the Promoter cannot be held liable for system failures on the website.
8. No third party, bulk, or automated entries. If it becomes apparent that a participant, or group of participants, are using any means to circumvent this condition such as, and without limitation, using multiple identities, acting fraudulently or dishonestly in the opinion of the Promoter, or otherwise acting in violation of these Terms and Conditions, these participants will be disqualified, and any prize entitlement will be void.
9. The one (1) winner will be drawn by an independent auditor at random from all valid and genuine entries received by the stated closing date. The first valid entry drawn will be deemed to be the one (1) winner of the NESCAFÉ Dolce Gusto Genio S Plus coffee machine.
10. The winner will be notified via email within seven (7) working days of the survey closing date using the email address included in their original entry. If the winner cannot be contacted after seven (7) days and three attempts of the original notification, or is unable to take the prize, the prize entitlement will be withdrawn, and the prize awarded to a reserve winner selected at the time of the initial prize draw. If the reserve winner cannot be contacted within 28 days of initial contact and after three attempts the prize will be withdrawn. The prize will be delivered within 28 days of confirmation of the winner’s address by courier or Royal Mail signed for service. The prize is not transferable. The prize is as stated. No cash alternative will be offered. The Promoter reserves the right to substitute the prize, should the stated item become unavailable for any reason, with an alternative of equal or greater value.
11. Promoter reserves the right to verify the winner, including asking for proof of age, identity and address, and to refuse to award the prize or withdraw prize entitlement where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, or any instructions forming part of this promotion’s entry requirements, or otherwise where a participant has gained an unfair advantage in participating in the promotion or won using fraudulent means.
12. The prize must be accepted as offered by the named recipient. There is no cash or other alternative item, in whole or part available in lieu of the stated prizes. The item is not transferable.
13. The Promoter reserves the right to provide alternative prizes of equal or greater value should circumstances outside its control make this necessary.
14. Promoter’s decision in all matters shall be final and binding.
15. The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the entry process or the operation of the survey and prize draw; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
16. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
17. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event, or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
18. The Promotion and these Terms and Conditions will be governed by the laws of England and Wales and any disputes as to the meaning of these Terms and Conditions will be subject to the exclusive jurisdiction of the participants’ local courts.
19. By taking part in the promotion, the winner agrees that the Promoter may contact them to ask whether they want to participate in marketing activities/PR relating to this promotion only. Such publicity may include, without limitation, the entrant’s name and/or if consent given, image or statements made by entrants concerning the promotion and/or prize obtained as part of the promotion. The winner is not obliged to agree to any such request.
20. Subject to the Promoter’s Privacy Policy which can be found at Policy https://www.nestle.co.uk/en-gb/privacypolicy, the surname and county of the main prize winner only will be available upon request by sending an email to: consumer.services@uk.nestle.com with the subject line “WINNERS’ LIST: NESTLÉ PROFESSIONAL NESCAFÉ HEALTHCARE 2024 SURVEY PRIZE DRAW” for a period of three months following the end of the promotion. The Promoter reserves the right to refuse any or all such requests. When contacting this email address, your request will be actioned in line with Nestlé’s Privacy Policy. If the winner objects to their information being published, then they can contact the Promoter by emailing: UKI.Dataprotection@uk.nestle.com with the subject line “WINNERS’ LIST: NESTLÉ PROFESSIONAL NESCAFÉ HEALTHCARE 2024 SURVEY PRIZE DRAW”. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so.
21. Data Protection: The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent and you have opted-in to receive future marketing communications or prize PR. The surnames and counties of the verified winner will be made available as set out above and the winner can object to this by emailing: UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential, and in accordance with the General Data Protection Regulation (GDPR). For the purpose of this promotion, requests to delete personal data can only be actioned after the promotion has concluded and the winner(s) accepted their prize. Any data obtained via this promotion will be deleted after three (3) months of the promotional end date with the exception of the winner(s) and/or reserve(s) whose data will be deleted after fulfilment of the prize.
22. No responsibility can be accepted for any entries that cannot be made, due to technical errors, or any other reason whatsoever.
23. If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable, then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
24.
