FULL TERMS AND CONDITIONS 

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the Terms and Conditions and by participating all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Participants should retain a copy for their information. 

By entering this promotion, participants confirm that they have read the Promoter’s Privacy Policy and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the campaign, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018. 

  1. This Promotion is only open to Foodservice Professionals/Buying Group Members with a registered business address in the United Kingdom (England, Scotland, Wales, or Northern Ireland), and aged 18 or over, excluding employees and their immediate families of Nestlé UK Ltd., its agents, affiliates, or anyone else professionally associated with the administration of the promotion.  
     
  2. Internet access required. 
     
  3. Purchase of a pack of MAGGI® PROFESSIONAL RICH AND RUSTIC 800g or 3kg tin required. Participants are required to retain the itemised receipt/invoice clearly showing the purchase of the relevant product purchased between 01.09.23 and 23:59 on 30.09.23 as proof of purchase.        
     
  4. Participants may enter the prize draw as many times as they wish, provided each entry is supported with a new itemised receipt/invoice showing a qualifying purchase made between the stated promotional dates.   
     
  5. Any entrant trying to circumvent the rules stated in these Terms and Conditions by using alternative details, setting up multiple accounts, using multiple identities, entering on behalf of others, or otherwise acting in a manner deemed by the Promoter to be in violation of the Terms and Conditions will be disqualified from this promotion.  
     
  6. Bulk entries made from trade groups, consumer groups, agents, third parties or syndicates will not be accepted.  
     
  7. Promotional Period: Purchases made after 23:59 on 30.09.23 will not qualify for entry into the prize draw.  A valid entry will comprise of:
    • A current and valid business email address.
    • An uploaded photo of a valid itemised till receipt/invoice from a recognised wholesaler as outlined above, showing one (1) pack of MAGGI® RICH AND RUSTIC 800g or 3kg tin only.
  8. The Promoter reserves the right to refuse any uploaded till receipts/invoices/proof of purchases that:
    • Are out of focus/blurry
    • Do not have the correct product clearly visible
    • Are old, out of date or fall outside of the stated promotional period
    • That show purchase locations in geographical locations outside the stated promotional area
    • Are not unique to the individual.
  9. The Promoter reserves the right at its sole discretion to disqualify any individual found to be tampering with or altering till receipts. Any attempts to submit any invalid till receipts may result in the participant’s application being frozen and possibly deleted. The Promoter reserves the right to verify the eligibility of all entries to protect itself against fraudulent, invalid, or repetitive entries including, without limitation, to require the participant to prove that they did not return the product within the period of 14 days from the date of purchase. Statutory rights are not affected.
     
  10. No duplicate itemised till receipts will be accepted. The Promoter reserves the right to disqualify any claimant attempting to use multiple names, false names, or attempts to manipulate receipts. The Promoter reserves the right to refuse to accept any entry that it believes to be in breach of these Terms and Conditions.
     
  11. All valid entries received by 23:59 on 30.09.23 will be included in the prize draw, which will take place within 14 days of the entry closing date. There is one prize available to be won consisting of a pair of hospitality box tickets in the Nestlé Corporate Box at the O2 Arena, London for the Peter Kay show schedule to take place on 20th April 2024. The prize does not include travel or accommodations costs and any such expenses will be the sole responsibility of the winner and their guest. The winner and their guest must be 18 or over. The Promoter cannot be held responsible for any changes to the date or venue of the show which is outside of its control.
     
  12. The winner will be drawn at random via an independently verified computer programme from all valid entries received by the stated closing date.
     
  13. The first valid entry drawn will be deemed the winner.  If the winner cannot be contacted within 14 days and after three attempts, or cannot take up the prize for any reason, the prize entitlement will be withdrawn, and the prize will pass to a reserve winner drawn at the same time as the original winner. If the reserve winner cannot be contacted within 14 days and after three attempts, or cannot take up the prize, the prize entitlement will be withdrawn. The process will be repeated until a valid winner can be found.
     
  14. Any personal/business tax liability arising from taking part in this promotion will be the responsibility of the individual participant/business.
     
  15. No entries from agents, third parties, organized groups, syndicates, or aliases will be accepted. No incomplete, corrupted entries, or multiple entries from the same person beyond the limit will be accepted. Only genuine valid entries will be included in the prize draw for a chance to win.

    Promotional Period  
     
  16. The promotion is open for entries from 00:01 01.09.23 to 23:59 on 30.09.23.  

  17. All valid entries received during the promotional period as detailed above will be entered into the prize draw. Entries made after the final closing time and date will not be accepted. 

  18. The winner will be notified via email using the email address as submitted in their original entry. In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address. 

  19. The winner will be subject to a verification process which may include, but not be limited to, the checking of business information. 

  20. Once the prize claim has been verified the winner will be sent all necessary details relating to the prize.

    Prize Details   

  21. The following elements are included in the prize package, subject to availability:   

    • Access to the official Nestlé Box at the O2 Arena, London for the Peter Kay Show scheduled to take place on 20th April 2024 only.
    • Complimentary selection of craft beers, wines, and soft drinks (alcohol available for adults only) and a set menu will be provided. The winner and their guest will be responsible for advising the Promoter of any food allergies in advance.
    • The prize is valid for the Peter Kay Show only and cannot be used for any other show. No cash or other alternative will be available in lieu of the prize should the winner and their guest be unable to attend on the stated date.
    • The Promoter cannot be held responsible for any date and/or venue changes, which are outside its control but will endeavour to manage the prize arrangements to minimise disappointment.
    • The winner and their guest must be 18 years of age, or over.
    • The winner and their guest will be met by a Nestlé Professional representative at the O2 Arena and escorted to the Nestlé Hospitality Box. 
  22. Ticket dates are fixed as outlined in above, and no other dates will be available, except where circumstances outside the Promoter’s control (such as cancellation) make it necessary. Participants must be available and willing to attend on the date shown, as no alternative dates will be available to the winners regardless of personal circumstances.    

  23. The prize is strictly non-transferable and must not be sold, auctioned, or advertised for sale whether on the internet, in newspapers or elsewhere. Any person found in breach of this clause will be disqualified from participating.  

  24. The winner and guest are responsible for all expenses not expressly stated in these Terms and Conditions as being included as part of the prize. All other costs and expenses incurred from the prize including, but not limited to, transport to venue, meals, additional drinks, merchandise and other gratuities or any other expenses are at the winner’s and their guest’s own cost.  

  25. The Promoter, their agents and the event organiser reserve the right to deny access to participants who arrive late; or deny access or remove, any persons who it deems to be rude or disruptive, or who appear to be under the influence of excess alcohol or any other intoxicating substances.  

  26. The event organizer may require participants to be searched for security reasons. Declining to be searched, abusive, threatening, drunken or other anti-social behaviour, carrying offensive weapons or illegal substances may result in the individual being removed from the event. No cash or other alternative will be offered to prize winners or their guests who are refused entry or ejected in such circumstances. No cans, bottles, alcohol, or food to be taken into the venue.     Winner Selection and Notification 

  27. The winner will be randomly selected via an independently supervised draw from all the valid entries received during the stated entry dates. The prize draw will take place within five (5) working days of the closing dates. 

  28.  The Promoter will send an email to the winners (using the email address submitted upon entry) within two (2) working days of the prize draw. The email will notify the winners that they have won (subject to verification) and will give the winners information on the prize and claim procedure to allow the prize to be fulfilled. 

  29. In order to claim the prize, the winners will be required to respond within 14 days of the initial email, providing details including their full name, a valid home address, proof of Identification and any other information required to verify their win via the secure link, in order to allow the claim process to be fulfilled. Inaccurate information may result in the prize being forfeited.  

  30. If the winner cannot be contacted after 14 days and after three attempts of original notification, or is unable to take the prize, the prize entitlement will be withdrawn, and the prize awarded to reserve winner selected at the time of the initial prize draw. The prize will be sent to the email address provided upon entry within seven (7) days of confirmation of the winner successfully passing verification. The prize is not transferable. The prize is as stated. No cash alternative will be offered. The Promoter reserves the right to substitute the prize, should the stated item become unavailable for any reason, with an alternative of equal or greater value.  

  31. The Promoter accepts no responsibility for issues with delivery or collection of the prize due to provision of incorrect contact details by the entrant. 

    General 

  32. By taking part in the promotion, the winner agrees that the Promoter may contact them to ask whether they want to participate in marketing activities relating to this promotion only.  

  33. Winner’s List: Subject to the Promoter’s Privacy Policy which can be found at https://www.nestle.co.uk/en-gb/privacypolicy , the surname and county of the verified prize winner will be available upon request by sending an email to: consumer.services@UK.nestle.com  with the subject line ‘WINNER’S LIST: MAGGI PROFESSIONAL RICH & RUSTIC PETER KAY PRIZE DRAW’ for a period of three (3) months following the end of the promotion. The Promoter reserves the right to refuse any or all such requests. When contacting this email address, your request will be actioned in line with Nestlé’s Privacy Policy. If the winner objects to their information being published, then they can contact the Promoter by emailing: UKI.Dataprotection@uk.nestle.com with the subject line ‘WINNER’S LIST: MAGGI PROFESSIONAL RICH & RUSTIC PRIZE DRAW’. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. 

  34. Data Protection: The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent and you have opted-in to receive future marketing communications. As part of this promotion, if you are not opted-in into our general marketing communication, you may still receive an email or phone call to let you know if you have won and to arrange delivery of your prize. The surname and county of the verified winner will be made available as set out in the paragraph above and the winner can object to this by emailing UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential, and in accordance with the General Data Protection Regulation (GDPR). By participating in the promotion, you agree to the use of your personal data as described here. You can withdraw your consent at any time. For the purpose of this promotion, requests to delete personal data can only be actioned after the promotion has concluded and the winner(s) accepted their prize. Any data obtained via this promotion will be deleted after three (3) months of the promotional period with the exception of the winner(s) and reserves whose data will be deleted after fulfilment of the prize.    

  35. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, or reasonable belief to suspect collusion to subvert the Terms and Conditions of this promotion, and/or an error (human or computer) affects or could affect the proper operation of this promotion, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these Terms and Conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment. 

  36. The Promoter reserves the right to verify all entries including but not limited to asking for address and identity details (which they must provide within 14 days) and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. 

  37. If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect. 

  38. The Promotion and these Terms and Conditions will be governed by the laws of the participating country but any disputes as to the meaning of these Terms and Conditions will be subject to the exclusive jurisdiction of the participant’s local courts. 

  39. Limitations of liability: insofar as permitted by law, neither the Promoter nor the promotional parties assume any responsibility or liability for:- 

    • Any incorrect or inaccurate entry, or for any faulty, incorrect errors or failed electronic data transmissions
    • Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion
    • Inaccessibility or unavailability of the internet or the website or any combination thereof
  40. If for any reason any aspect of this promotional offer is not capable of running as planned due to events outside of the Promoter’s reasonable control, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotional offer, or invalidate any affected entries (this includes, without limitation, by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion). 

  41. The Promoter’s decision in all promotional matters is final and binding. 

  42. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
