These Terms and Conditions (the “T&Cs”) prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the T&Cs and by participating all entrants will be deemed to have accepted and be bound by the T&Cs. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering this prize draw promotion (the “Promotion”), the entrant confirms that they have read the Privacy Policy, and understand and agree to these T&Cs of the Promotion. By submitting any information required as part of their entry in the Promotion, entrants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

Promotional Eligibity

  1. The Prize Draw Promotion is only open to employees responsible for purchasing food and beverages for their company. Entrants must be residents of the United Kingdom (England, Scotland, Wales and Northern Ireland), the Isle of Man or the Channel Islands, and be aged 18 or over. Employees (and their immediate families) of the Promoter, its agents, affiliates or anyone else professionally associated with the administration of the Promotion are excluded from entry.
  2. Internet access via promotional link, proof of purchase and personal and business registration are required for each entry. 
  3. Entrants must obtain their employer’s permission to take part. Any personal/business tax liability arising from taking part in the Promotion will be the responsibility of the participant/business. It is recognised by agreeing to this consent that any prize will be for company use only. The winner/business accepts that for the working office workplace Coffee Space makeover prize (not home office), PR activity will support the thought process, design and project implementation of the office makeover and that the winner/ business will be recommended to agree to and actively contribute to this publicity.
  4. Entry is only valid via the promotional website at: www.nestleprofessional.co.uk/nescafe-goodcoffeebreak
  5. No purchase necessary postal entry route for Northern Ireland residents/businesses only.  
  6. There is a maximum of one (1) win type per person and one (1) win type per business. There is no limit on the number of times a participant may enter, or if different individuals are responsible for purchasing food, provided a different proof of purchase is uploaded for each entry. The Promoter reserves the right at its sole discretion to disqualify any individual found to be attempting to circumvent this clause by tampering with the operation of the promotion, setting up multiple accounts, using multiple identities or to be acting in any manner deemed by the Promoter to be in violation of the terms and conditions; or to be acting in any manner deemed by the Promoter to be disruptive. 
  7. No entries from other trade groups, agents, third parties, organised groups, syndicates or aliases will be accepted. 

Failure to comply with any part of these clauses will disqualify the respective participant and any entries made by them from the Promotion.

Promotional Period

  1.  The prize draw for the first prize of the Coffee Space makeover plus free workplace coffee for a year, and the runners up prizes of 1 of 5 Workplace Coffee for a year prize, will be open to all valid entries received between 00.01 12/04/2021 and midnight 31/07/2021.
  2. Entries received outside of these dates will not be included in the prize draw.


Entry Requirements

  1. To enter for a chance to win in the prize draw for the first prize of a working office workplace Coffee space makeover worth £10,000, and the PR that will support the development and build of the space, plus free workplace coffee for a year (quantities to be determined based on the number of business team personnel in the winning business); 

and/or

one of five runners up prizes of a year’s supply of NESCAFÉ® Coffee for their workplace:

Participants are required to:

a.    Purchase a participating qualifying NESCAFÉ® product between the stated promotional dates; 
b.    Visit the following website: www.nestleprofessional.co.uk/nescafe-goodcoffeebreak.
c.    Type full name, personal email address, business company name, address and phone number, and upload a genuine valid proof of purchase. The proof of purchase details must be unique, clearly indicate the qualifying product purchased, and be dated within the Promotional Period. Participants should  retain their proof of purchase (till receipt or invoice) which may be called for as part of the winner verification process. 
d.    Confirm via a tick box that they have read and understood the Terms and Conditions, particularly that it is a working office workplace makeover and thus accept being responsible for purchasing food and beverages for the company and that both the employer and the participant consents to their entry into the prize draw and the various conditions therein.

  1. In the event that the specified information is not provided, or incorrect and/or both check boxes are not ticked, the entry will be considered incomplete and therefore invalid.

  1. Entrants will receive an on-screen message confirming their entry.
  2. Proof of purchase details can only be used once. Entrants who do not give the correct information, or those who attempt to make an entry on someone else’s behalf, will be disqualified. The Promoter reserves the right to refuse any uploaded proof of purchase/receipts that:

a.    Are out of focus/blurry;
b.    Do not have the correct product clearly visible;
c.    Show a purchase date outside of the Promotional Period;
d.    Show store locations in geographical locations outside the stated promotional area; or
e.    Are not unique to the individual or the registered company.

  1. Incomplete, illegible or misdirected entries, entries received outside any Promotional Period, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these T&Cs in full will be disqualified and will not be included in the prize draw. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by using multiple IP addresses, using identities other than their own, the use of programme, alias or multiple accounts or any other automated means in order to increase that entrant’s entries into the Promotion in a way that is not consistent with the spirit of the Promotion, that entrant’s entries will be disqualified and any prize award will be void.
  2. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed or lost due to technical reasons or otherwise. 
  3. To enter without purchase in Northern Ireland only – send your full name, age, full business postal address and email address to: [email protected]  (a “No Purchase Necessary Request”). All “No Purchase Necessary Requests” will be reviewed to ensure that the details provided are legitimate and associated with genuine business addresses located within Northern Ireland. Once a “No Purchase Necessary Request” has been verified, the entrant will be notified by email that they have been successfully entered into the  prize draw. Only one entry per email request. A maximum of two (2) entries permitted per person throughout the Promotional Period. “No Purchase Necessary Requests” must be received by the Promoter no later than 23.59 on 24/07/2021 so that they can be processed before the end of the Promotional Period. Only winners will be notified.

No Purchase Necessary requests will be subject to verification. 

The Prizes

  1.     There is

One (1) working office workplace Coffee Space makeover worth £10,000 for the winner’s workplace and the PR that will support the development and build of the space, plus free workplace coffee for a year (min 9kg).

To a maximum value of £10,000 the prize includes design, cost of materials and installation of a new coffee space/breakout area, all within agreement of the winner, any relevant planning permission and carried out by Nescafé selected 12th parties. The space can only be applied to a recognised working office address and cannot be used in a home office environment. The makeover progress will be documented through photographer and film and once agreed will be used for future PR purposes and social media. The winner is recommended to agree for use of all imagery and video content by Nescafé as part of the winning process.
 
The makeover can include; kitchen counters and cupboard space including installation, upgrade to Nestle Coffee Partners coffee and tea equipment, new seating and table areas, flooring, lighting and wall decoration, within the budget parameters of £10,000. Following an initial meeting and survey of the site the plans will be developed and confirmed within the budget requirements.  
 
The makeover cannot apply to non-breakout or coffee spaces and these will be approved at the discretion of Nescafé, only one (1) space is included in the promotional prize fund. Upon winning the prize a representative for Nescafé will attend a site visit to discuss next steps and access the space suits the requirements of the prize giving, if it’s not deemed suitable an alternative space will need to be considered. The money cannot be used to renovate any other areas within the office and no third parties beyond recommended suppliers of Nescafé can be used for the works.
 
A coffee space/breakout area is described as a space in which employees can meet/break from work, and offers tea and coffee facilities.


And/or

One of five Runners up Prizes of a year’s supply of coffee for the winner’s workplace (based on average consumption and number of managers & employees with a minimum of 9 kg of coffee in total).

The minimum amount of coffee delivery will be 9kg based on average consumption and number of business team personnel at workplaces. The Promoter will require details from the winner to determine the final volume of coffee and the delivery method required to meet the ‘one year of coffee’ promise. 

The coffee will be delivered to the workplace either in four quarterly deliveries throughout the year, September, January, April and July or every six months based on the volume agreed with the winning business. This will be fulfilled by Nestlé Professional and delivered by SDS, Specialist Distribution Services Ltd. 


Winner Notification and Prize Fulfilment

  1. The promotional prize draw will take place on 02/08/2021.
  2. All winners and reserves will be selected at random via an independently audited and verified prize draw selection computer process from all valid entries received during the Promotional Period. 
  3. The winner of the Coffee Space makeover worth £10,000 for the winners working office workplace and the PR that will support the development and build of the space, plus a year’s supply of free workplace coffee, will be notified within 48 hours of the closing date of the draw via the personal email address provided on registration. 

The potential winner will be given  instructions within that email for the next steps of the claim process. 

The Promoter will request that the potential winner  provides/confirms to the Promoter via a secure link, and within 28 days information including:    

  • Confirmation of their name 
  • A direct or mobile telephone number
  • Proof of age, details of their current business address 
  • Details of the office space and address that they are hoping to develop with the winnings
  • The valid receipt showing the details of their initial qualifying purchase
  1. The Promoter has the right to refuse to grant the winner the prize, if it is proven that there is any fraudulent case associated with the office redelopment activity Only once all details have been verified and validated, the winner will receive a confirmation email/ telephone call informing them of plans, dates and next steps for them and the designer to discuss the Coffee Space makeover. This initial representation should take place within 28 days of the date of verification. Delivery arrangements for the year’s supply of coffee will  also be discussed and agreed within the timescales specifed. It is the responsibility of entrants to check junk/spam folders to ensure they are in receipt of any communications. Inaccurate information may result in the prize being forfeited. Winners should retain their notification/personal email message until their win has been verified and their prize delivered.
  2. “Coffee for a Year” winners will also be contacted via the personal email address provided on registration within 48 working hours of closing date of the draw giving instructions for the next steps of the claim process. The Promoter will request potential winners to provide/confirm to the Promoter in a secure link within 28 days information including: 
  • Confirmation of their name  
  • A direct or mobile telephone number 
  • Proof of age, details of their current business address 
  • The valid receipt showing the details of their initial qualifying purchase

Further discussions/information gathering will then occur once validated to calculate the amount of coffee for a year relevant to the winners business requirements and dispatch details and amounts delivered throughout the year will be confirmed and actioned.

  1. The Promoter will make reasonable efforts to contact both the Coffee Space makeover winner, and the runners up winners of the ‘Coffee for a Year’, however, if a winner cannot be contacted after 28 days of the original notification and after three attempts, or if a selected winner is ineligible, otherwise in breach of these T&Cs, or unable to take up their prize for any other reason, the prize entitlement will be withdrawn. In such circumstances, the Promoter reserves the right to select a reserve winner from a list of reserves selected as next in line at the time of the initial prize allocation. For all prizes this process of drawing reserves will continue/repeated until an eligible winner is able to claim the prize, or after three reserves have been tried after which any prize will be forfeited and withdrawn from the promotion. 
  2. If the original entrant is no longer employed by the business stated on entry but the company is still a viable entity then the prize will be awarded to the company. If the company cannot be contacted, or is not in business then the prize will be forfeited and a reserve winner will be selected using the same methodology as described above. This process will continue and be repeated until an eligible winner/company is able to claim the prize. 
  3. Neither the Promoter, nor its agents, accept any responsibility for failed delivery due to provision of incorrect contact details by the winners. It is the responsibility of winners to provide their correct, up to date details at the time of acceptance in order for the prize to be processed. Failure to provide a valid postal address may result in the prize being forfeited and the prize entitlement withdrawn, and any prize that is returned as undelivered will be assumed unwanted and shall also be forfeited.

The first delivery of the ‘Coffee for a Year’ will arrive within 28 days of verification and calculation of the amount due, in September. This delivery will take place by our chosen courier. Subsequent deliveries will take place by the same method at quarterly intervals in December, March and June.

General

  1. The prizes are not transferable, negotiable, refundable or exchangeable. 
  2. In the event of a personal email address becoming inaccessible during the Promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.
  3. The Promoter reserves the right to refuse to award a prize, or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these T&Cs, the spirit of the promotion, any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating or won using fraudulent means. 
  4. If, for any reason, any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion modify or suspend the Promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter, and which prevents the Promoter from complying with these T&Cs, the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to entrants in order to avoid undue disappointment.
  5. The Promoter and any associated agencies and companies will not be liable for any loss (including indirect, special or consequential loss or loss of profits or income), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with the Promotion or accepting or using a prize, except for any liability which cannot be excluded by law. 
  6. Limitations of liability: neither the Promoter, its agents or anyone professionally connected to the Promotion, assume any responsibility or liability for:

a.    Any incorrect or inaccurate entry of information, or for any faulty or failed electronic data transmissions;
b.    Any communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this Promotion; or
c.    Inaccessibility or unavailability of the Internet or the website or any combination thereof.

  1. Winners list: subject to the Promoter’s Privacy Policy, the surnames and counties of all verified winners will be available upon request by sending an email to [email protected] with the subject line ‘WINNERS LIST NESCAFÉ COFFEE WORKPLACE MAKEOVER  TRADE PROMOTION 2021’ for a period of three (3) months following the end of the Promotion. The Promoter reserves the right to refuse any or all such requests. In addition, by taking part in the Promotion, “Coffee for a Year” runners -up also agree that the Promoter may contact them to ask whether they want to participate in publicity relating to the Promotion for which consent will be required. If any winner objects to their information being published, then they can contact the Promoter by emailing [email protected]. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so.
  2. The Promoter’s decision is final and binding with regard to all promotional matters. 
  3. If any provision of these T&Cs are judged to be invalid, illegal or otherwise unenforceable, then it shall be severed and deleted from these T&Cs and the remaining clauses shall survive and remain in full force and effect.
  4. The Promotion and these T&Cs will be governed by the laws of the participating country and any disputes as to the meaning of these T&Cs will be subject to the exclusive jurisdiction of the participants’ local courts.
  5. Data Protection: the Promoter will only use the personal details supplied for the administration of the Promotion and the auditing of the entries where necessary and for no other purpose, unless the Promoter has your consent and you have opted-in to receive future marketing communications. As part of this Promotion, if you are not opted-in into our general marketing email, you will still receive emails for this Promotion only to let you know if you have won and to arrange delivery of your prize. The surnames and counties of verified winners will be made available as set out above, and winners can object to this by emailing [email protected].
