Toque d'Or 2021 Competition Full Terms and Conditions

These Terms & Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the Terms & Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms & Conditions. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering in this promotion, participants confirm that they have read the Privacy Policy, and agree to these Terms & Conditions of the promotion. By submitting any information required as part of their participation into the campaign, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

  1. Competition open to qualifying UK & ROI residents only. 
  2. Registration opens online at 00:01 on 18/02/2021 and closes at 23:59 on 16/03/2021. 
  3. All competitors will be registered for, and compete individually, representing their college or business. Some competition challenges will require teamwork, as determined by the organiser.
  4. Apprentices will be Level 2 (or a national equivalent) or above, participating in a full-time recognised Apprenticeship and agree to be bound by the terms and conditions.
  5. Young professionals will at equivalent to commis chef, commis waiter, chef de partie role. These competitors are in the equivalent level of an apprentice, therefore, they will compete within the same strand.
  6. Students will be Level 2 (or a national equivalent) or above, participating in a full-time recognised course and agree to be bound by the terms and conditions.
  7. Toque d’Or® 2021 has four (4) competition strands – students back of house, students front of house, apprentice and young professionals back of house, apprentice and young professionals front of house. Competitors can only register for one strand.
  8. Students must be registered individually by their lecturer to represent their college. All students within the same relevant level of study can be enrolled by their lecturer to take part on Toque d’Or® 2021. Toque d’Or will accept a maximum of two (2) back of house students per college and two (2) front of house students per college to go to the Heats. 
  9. Apprentices and young professionals can either register themselves or their employer can register them. Toque d’Or will accept a maximum of two (2) back of house apprentices and young professionals and two (2) front of house apprentices and young professionals per employer to go to the Heats. 
  10. Full details of the tasks to be undertaken can be found on the Toque d’Or® website at https://www.nestleprofessional.co.uk/toque-dor. All lecturers, employers, apprentices and young professionals will be required to complete the registration form giving their full name, college/employment details and contact details. Participants will be asked to complete a tick box to confirm they have read and accepted these terms and conditions.  
  11.  HOW TO REGISTER - LECTURERS: 
  • Lecturer completes an online registration form for each of their relevant level of study students’. All students from the same relevant level of study can be enrolled and all students who complete the entries will receive a certificate from Toque d’Or®. 
  • Lecturers do not need to disclose the data of the individual students they are registering but are required to confirm the number of students entered, for both back of house and front of house. If a lecturer wishes to enrol a different relevant level of study, they need to complete a new registration form online for each of the new relevant level of study students entered. 
  • Once the Toque d’Or® team have selected the students to go to the Heats, Toque d’Or® will notify the lecturer concerned. 
  • A third-party agency acting on behalf of the Promoter will contact the selected students in order to ask further questions, such as a suitable address to send deliveries to, their size to send uniforms, etc. 
  • From this point the Toque d’Or® team will assume permission has been granted to speak directly with those selected students via email to give them all necessary instructions relating to the next phase of the competition (the Heats).
  • Nominated students will be required to complete a virtual assessment, accessible via a link that will be provided. This assessment must be undertaken on 18/03/2021 (available from 08:00 to 23:59).
  • Students will be required to complete a multiple-choice questionnaire about sustainability and nutrition. Nominating lecturers should ensure their students have sufficient notification to allow them to prepare for the task and to review the study links provided.
  • As part of the assessment task, students will also be required to submit a one-minute video of themselves stating in their own words why they are passionate about hospitality and why they believe they deserve a place in the Toque d’Or® 2021 competition. Lecturers must ensure that students are advised in good time to allow them to prepare their video.
  • The Toque d’Or® team will choose the students to go through to the Heats based on their assessment and video scores.
  1. HOW TO COMPLETE THE REGISTRATION: APPRENTICES/PROFESSIONALS
  • Apprentices of Level 2 or above, in a full-time recognised apprenticeship and young professionals who are equivalent to commis chef, commis waiter or chef de partie role, will be required to register their details by no later than 16/03/2021.
  • Successful registrants will be contacted confirming their registration and with details of the task to be undertaken. The assessment will include an online assessment with multiple choice questions on sustainability and nutrition to be completed, plus the submission of a one-minute video of the applicant stating in their own words why they are passionate about hospitality and why they believe they deserve a place in the Toque d’Or® 2021 competition. This assessment will take place on 18/03/2021 between 08:00 and 23:59. 
  • The Toque d’Or® team will choose the apprentices / young professionals to go through to the Heats based on their assessment and video scores.
  1. HOW TO REGISTER: EMPLOYER
  • Employers may enter apprentices within their employ of Level 2 or above, in a full-time recognised apprenticeship, or young professionals who are equivalent to commis chef, commis waiter or chef de partie role. Employers will be required to register entrants details by no later than 16/03/2021.
  • Successful registrants will be contacted confirming their registration and with details of the task to be undertaken. The assessment will include an online assessment with multiple choice questions on sustainability and nutrition to be completed, plus the submission of a one-minute video of the applicant stating in their own words why they are passionate about hospitality and why they believe they deserve a place in the Toque d’Or® 2021 competition. This assessment will take place on 18/03/2021 between 08:00 and 23:59. 
  • The Toque d’Or® team will choose the apprentices / young professionals to go through to the Heats based on their assessment and video scores.
  1. ALL ENTRANTS/ENTRIES:
  • All entry videos must be uploaded to the participants YouTube channel before 18/03/2021 and the url for the video provided to the Toque d’Or® team for viewing during the assessment period on 18/03/2021. Contestants will need to upload their video to their YouTube channel (this video explains how if they don’t have one already) so they can include a link to it during the assessment on the 18/03/2021. Contestants will need to set the video's privacy settings to ‘UNLISTED’ so it can be viewed by the Toque d’Or® team but not by anyone else (except where the contestant themselves have chosen to share the url with other persons).
  • Once an entry has been submitted, revisions will not be accepted.
  • Entries to be submitted digitally by no later than 23:59 on 18/03/2021. Any entries received after the stated time/date will be not be eligible for inclusion in the competition. 
  1. HEATS
  • Due to the ongoing Covid19 situation all elements of the Heats will be carried out virtually. The shortlisted students, apprentices and young professionals will each be given their task on the 26/03/2021 and they will have to complete and submit the challenge on 15/04/2021.
  • A maximum of 40 different colleges can be selected to the Heats. Each college can have a maximum of two (2) Back of House and two (2) Front of House students selected to the Heats. A maximum total of 160 students can compete on the Heats. 
  • A maximum of 40 different businesses can be selected to the Heats, each business can have a maximum of two (2) Back of House apprentices/young professionals and two (2) Front of House apprentices/young professionals. A maximum total of 160 apprentices and young professionals can compete on the Heats. 
  • All competitors selected to go to the Heats will be contacted by Toque d’Or® and/or Toque d’Or’s logistic agency with next steps including asking for confirmation of details such as uniform sizes and home address for delivery of goods to complete the challenge. 
  • All competitors selected to the Heats will be asked to have an Instagram account, as part of the challenges will happen on this platform. They can either use an existing account or create one for the purpose of the competition. Any competitor who does not already have an Instagram account may open one by visiting www.instragram.com and following their instructions. Instagram terms and conditions and privacy policy will apply. Competitors are also required to follow @nestletoquedor and allow @nestletoquedor to follow them back. 
  • The Promoter also requires that participants have a suitable adult support person present during the competition in case of any accident or emergency arising and ensure they have access to first aid items. The Promoter is not responsible for the health and safety of participants and by taking part participants acknowledge that they do so at their own risk.
  1. GRAND FINALS 
  • Finalists will be announced on 30/04/2021, with the finals hosted in the last week of June. Final details of how these will be carried out will depend on the prevailing government guidelines on Covid19 at that time. 
  • A maximum of 12 competitors will go through to the Finals (3 x Back of House students; 3 x Back of House apprentices/young professionals; 3 x Front of House students and 3 x Front of House apprentices/young professionals). 
  • The winners of Toque d’Or® 2021 will be revealed to finalists, judges and those directly involved with the event organisation on the last day of the Finals week at the end of June. 
  1. AWARDS
  • The winners will be publicly announced via a live virtual awards ceremony on YouTube in July date TBC. All competitors attending the Awards ceremony will be asked to sign a Confidentiality Agreement/Non-Disclosure Agreement stating that they will not disclose details of the winners of the Toque d’Or® 2021 competition before these are publicly announced during the YouTube Live presentation in July.
  • There will be four (4) winners in total: one Back of House Student, one Back of House Apprentice/Young Professional, one Front of House Student and one Front of House Apprentice/Young Professional.
  • All finalists and a representative from their college/business will be invited to attend a virtual Awards which will take place in July (day TBC) as a live stream via Youtube. The Awards will be set to ‘Public/Global’ and can be viewed by any interested parties. In the event of any circumstances arising to prevent the airing of the awards on the stated date/time, an announcement will be made on the official Toque d’Or® Facebook page
  1. By taking part in the promotion, winners agree that Nestlé may contact them to ask whether they want to participate in marketing activities relating to the promotion. 
  2. By providing an entry, each participant grants the Promoter and its agents the right to publish, use, reproduce, distribute, make available, edit and/or modify the entry including recipes, in any way, in whole or in part, in commerce and in any and all media worldwide now known or hereinafter developed, in perpetuity and without consideration or notice to the participant. Providing any entry further constitutes the participant’s transfer to the Promoter of any and all rights, title, and interest in and to the entry and the entrant’s likeness, including, without limitation, all intellectual property rights.
  3. Entrants must be available to attend the virtual Heats and the face-to-face Grand Finals (Covid19 protocols permitting) on the dates, and at the virtual venues, as specified by the Promoter and have access to Teams, Zoom and Instagram in order to participate. The Promoter will send all necessary links to the participants prior to the event. However, it will be the participants responsibility to ensure they have all necessary connections enabled and have a suitable wi-fi connection and/or sufficient credit/data for the duration of the event. The Promoter reserves the right to amend these arrangements in the event of unforeseen circumstances. 

DATA PROTECTION/PRIVACY POLICY

  1. Subject to Nestlé’s Privacy Policy, the surnames and colleges/venues of verified winners will be available upon request by sending an email to: [email protected]. with the subject line ‘WINNERS LIST: ‘Nestlé Professional Toque d’Or® 2021’ for a period of 3 months following the end of the promotion. If any winner objects to their information being published, then they can contact us by emailing [email protected] with the subject line: ‘Nestlé Professional Toque d’Or® 2021 Promotion’.
  2. Data Protection: The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications.  The surnames and colleges/venues of verified winners will be made available as set out in Clause above and winners can object to this by emailing [email protected]. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable. By participating in the promotion, you agree to the use of your personal data as described here. You can withdraw your consent at any time. For the purpose of this promotion, requests to delete personal data can only be actioned after the promotion has concluded. Personal details entered on the Nestlé website will not be shared with any other third party. 

GENERAL 

  1. Limitations of liability:  Neither the Promoter, its agents or anyone professionally connected to the Promotion, assume any responsibility or liability for:
  • Any for any faulty or failed electronic data transmissions. 
  • Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this Promotion. 
  • Inaccessibility or unavailability of the internet or the website or any combination thereof.
  1. Incomplete, illegible, misdirected or entries received outside any promotional period will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
  2. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
  3. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms & Conditions and the remaining clauses shall survive and remain in full force and effect.
  4. The Promotion and these Terms & Conditions will be governed by the laws of England and Wales and any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participants’ local courts.
  5. In the event of circumstances outside the Promoter’s reasonable control and only where circumstances make this unavoidable, the Promoter and those partnered with the competition reserve the right to cancel or amend the competition or these Terms and Conditions at any stage but will endeavour to minimise the effect to entrants in order to avoid undue disappointment.
